This is purely hypothetical, and I truly believe he is an American citizen. But, lets say a court rules he has to show his birth certificate and he was born in Kenya. What next? He would be out office, and Biden would have to step in? But how embarressed would the American people be?What do you think would happen if Obama really was not a true American citizen?
I think a lot of people have the right impression here, but are missing some things... if I am understanding your question. So, what I think, if this were the case, then obviously he would be out office because of other situation that have been previously shown that if it were the case he was not born in the United States, then he would not be a citizen (something to do with his mom's age and his dad not being a citizen at the time). But, then Biden, which is terrifying because the guy said he would be scared to be on the same plane as someone who sneezed because of the swine flu, would step in. That would be ridiculous and I am pretty sure very embarrassing. But, I think a lot of Republicans would rejoice and do the ';i told you so'; routine, which while they may be happy, I think it will do a lot of damage to the United States reputation and we would become a laughing stock. At the same time I think it would worse for Democrats because of how they stood behind the fact saying that everything was okay and that he obviously was and it would kind of let them out to be liars/cheats, which would not be good at all either.
Not saying it is going to happen, but if it did, I think it would be interesting time. I might actually watch a news channel if this happened! What do you think would happen if Obama really was not a true American citizen?
It's actually a bit more complicated that just showing the birth certificate. If a court (or a Congressional subpoena, more likely) investigated and discovered that Obama wasn't born in the US, then the next question is does that mean he's not a natural born citizen. That's not clear. Some legal scholars contend that since birth outside the US to a citizen resident in most cases means that the US citizen transfers citizenship to the child. Born a citizen=natural born citizen. The age of the mother would be a factor, unless she wasn't married (Obama Sr. already had a valid marriage when he married Ann Dunham). The case would go to the Supreme Court at some point for clarification.
But if whatever chain of events resulted in impeachment/conviction or resignation, then Biden would be President. Biden would nominate a new VP, who would be confirmed by both houses of Congress. If Biden were then impeached/convicted, the new VP would move up and the process would repeat.
All laws, regulations, treaties, executive orders, and appointments would stand, they wouldn't be rolled back or negated. The concept is called the De Facto Officer Doctrine and is well-established in law. If an officer (the President is an officer) is later found to be fraudulent, his official acts are still valid. That's because the OFFICE is valid, even if the person occupying it isn't. The acts aren't do-overs.
But there's no real evidence that Obama was born anywhere but in Hawaii. That's all he needs. Parental status doesn't matter, and children can't lose their US birthright citizenship unless they can convince a US Counsulate that they fully understand what they are giving up. Six-year-old kids certainly can't.
What would likely be next is to appeal the decision on grounds that the court lacked the authority to do so. The other problem is that no law defines natural-born.
Keep in mind that the burden of proof is solely on the plaintiff; Obama has to show nothing unless/until proof is given to the court by the plaintiff.
If you had proof, he would have to step down as president unless Sotomayor and the other liberals on the supreme court ruled the constitution was no longer valid and we no longer had to live by it. Much like what happened in New Jersey about 10 years ago when the state constitution said a candidate for Gov. had to declare his candidacy by a certain time in order to be eligible but the democratic controlled state supreme court over ruled that saying it was to important an election to not let the democrat who didn't register in time not run.
I don't really like Obama but I think it's annoying when people are sore losers and try finding a way to knock him out of office. They are like the 9/11 truthers when it comes to lies, I honestly don't see the point of it anyways. If it happened (which isn't likely) Obama would probably be impeached and Joe Biden would succeed him. Is that really any better? I think both parties can agree that we'd rather have Obama than the clueless idiot.
He would be impeached, since the Constitution of the United States mandates that each President must be born in America, and then arrested for lying about it.
But he isn't. He's a true American citizen, it's been proved.
The Birthers will win. CNN will have exclusive broadcast of Lou Dobb's celebration party.
McCain would probably be pissed. Hillary would probably be pissed.
Biden as president. That probably scares me more
The fact that virtually every court keeps tossing it out on standing--not merit, tells me it will never happen. And unfortunately, many would just say it didn't matter to them. It matters--they just do not get WHY.
Obama is a true US citizen.
Otherwise, he wouldn't have been able to run for President.
Some of us would rejoice in vindication, because we have known this all along.
everything he has done while POTUS would be *null and void*!
I enjoy engaging in hypotheticals...
