Is it true if an illegal alien marries a citizen, they become a citizen?

NO. Marriage never bestows automatic citizenship on a person. The illegal alien will have to return to their own country before any petition is filed, or they will be deported and barred for ten years.





To be a valid marriage, the parties must live together. If you are thinking of marrying an illegal alien, be prepared to live for at least one year and perhaps ten or more years, in the illegal alien's country of citizenship prior to being able to file a petition for a spousal visa and for temporary residence.

FALSE. Marriage alone does not make an illegal legal. The illegal alien must go through the same arduous process like everyone else, if not more so because sh/he is an illegal.

Did you know there are 2 million ';mixed status'; couples and familes in this country?? Including several military families.. this started to come out from the shadows when the citizen half of a ';mixed status'; couple was not allowed their tax stimulus check and some military families were outraged that just becuase they married a foriegn national without a valid SS# yet that they were not allowed their stimulus after serving the country..





Anyway, this idea of ';instant'; citizenship is not true at all





The process takes several years, thousands of dollars, a waiver packet inches thick that takes months to prepare (like a huge term paper), lots of stress, and lots of uncertainties.. I could rattle off dozens of sad stories of those who thought they would be elgible and weren't .. for example a couple where the husband was made to use a fake identity to enter when he was a minor - he is facing a lifetime ban with no waiver - he didn't do it his parents did. I know at least 10 other couples where the parents EWI (entered without inspection) more than once also with the child.. creating a LIFETIME ban with NO waiver for 10 years..





Most illegal immigrants face a 10 year ban which is waivable by the marriage to the U.S. citizen.. in all countries but Mexico it takes a year or more to process and see if your case is approved or denied.. meanwhile the families are broken up or the spouse and children who are CITIZENS must try adjusting to another country and lose their jobs, education, and lives. In Mexico there is the pilot program where clearly approvable cases can be issued a visa on the same day - however a large amount of cases are still ';backlogged'; taking the year amount or more.. thousands of families get stuck in ';name checks'; because they have a common name like Jose Gomez and someone with their name and DOB committed crimes and they can be stuck for YEARS while the government makes sure it's not them - something that can be quickly done with fingerprints but for some reason the families are made to wait for months or years ..





Once FINALLY in the U.S. if you are intelligent enough to have put together an approvable waiver packet (not an easy task - and lawyers? Forget about it! Never heard of this waiver process? Neither have most immigration lawyers. Immigraiton lawyers are rarely educated in all areas of immigration law and lawyers that can prepare waiver packets are VERY VERY rare - many people pay thousands of dollars $10k or more for a poorly prepared packet that looks like a high schoolers book report..) so if you get approved it still takes several more years to apply for citizenship and during those years the couples live in fear because PR can still be deported.. for example if someone breaks in your home and there is a scuffle between the PR husband and the intruder - he is at risk for being deported - they will often deport PR even if they were never officially charged with any violent crime ! Suspicion is enough.. they are US immigration they can do whatever they want..

It's not instant, you still have to apply for it and go through a process like everyone else.

3.) after 3 years with your green card you need to apply for US citizenship.
