i'd like to marry my american boyfriend.i need to get the green card but somebody told me the he has to be my sponsor and earn min 35000 a year.he doesn't earn that much.is it possible that i don't even get the green card because of that?If i as a foreigner marry an am.citizen,is it true that he has to have an min.income 35000 a year?
As of current, the only requirement through a sponsor, such as your boyfriend/spouse is that he must issue an affidavit proving that he can support you at or above 125% of the mandated poverty Line. with that affidavit and a marriage License, you would be eligible for a green card immediately. not so fast 1st marry for love not green card or your ideas will be flushed He has to earn 125 %above the poverty level thats just for one dependent marry then work your little assof to live your american dream
It depends on how many people are in his household. If he has no children and no parents to support, then the minimum is much lower than that. I think it is around $23,000. You can find the limits for 2008 on www.uscis.gov.
Yes he has to make 125% of the poverty line..but also you have to file for a fiancee visa..meet all the terms and conditions..file all the right papers..pay the fees..get a medical..have a passport and have a interview at the American consulate. This all takes months ( 10 months in my case) You then have 6 months to enter the states and 90 days to marry once you are in the states. You do not automatically get a green card then. You have to apply to get conditional permanent residence , again fill out all the forms and pay all the fees ..get fingerprinted and photographed go to interviews if necessary . This can also take months...you may not leave the country or work until this is all finished and you get your green card unless you fill out the proper forms and again pay the appropriate fees to get an advance parole ( allows you to reenter the States if you have to travel) and a work authorization document .. This is not a cheap or an easy process...good luck
