Basically, it is against OFAC rules to spend money travelling to Cuba, or to spend money in Cuba, without a licence from OFAC. If you are found to have travelled to Cuba, they will assume that you have spent money.

The US government is not going to tell you that you won't be punished if you break the law, will they ? They will try to imply that there is a risk.

Its people are risking their lives to escape from Cuba
yes there is but you can go to a small Caribbean county and fly there they will not stamp you passport.
The usa have a toll of 2 cents for anyone that travels to cuba
