Is it true that a child born in USA to non-Americans automatically becomes American citizen?

This rumor (popular in some Asian countries) says that such a child is considered American citizen under american laws.





One anecdote says that a foreign woman gave birth to a child aboard a ship which was temporarily docked at an American port and the child was claimed by American government as American citizen.





Is there such a law in USA? Or is it just a myth invented by a great story teller?Is it true that a child born in USA to non-Americans automatically becomes American citizen?

Section 1.


All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.Is it true that a child born in USA to non-Americans automatically becomes American citizen?
As the laws are now, yes. The law isn't likely to change unless the illegals REALLY make Americans mad at them.





Not sure about a baby born on a ship, but what's the chance of that happening here? If the ship is docked and there's a woman on board about to give birth, she would be taken to the nearest hospital. We are not cruel people to make a woman suffer an unattended childbirth to avoid an anchor baby (that's what a child born to a foreign national is called here)





Parents always keep the baby unless they are believed unfit parents (that the parents will hurt the child) or unless the parents give the baby away.
Yes it is true, its not just a myth.
yes, this needs to change. people that procreate in the USA, or prior to getting here are pregnant and have the baby here like that Ariello lady, should not be allowed to be citizens. If that woman really loved her young son she wouldn't be playing fast and loose with his well being. He is her ace in the pocket. She is manipulating him. We don't need more criminals here and she is a criminal if she used someone else's social security number to get a job, which she did.

As the poster above said, even Elvira Arellano's son...is a U.S. citizen, even though most of us are disgusted at such a despicable person that would abandon her child here for American taxpayers to support and was not sentenced to prison for her felony crime.
Yes, if a child is born in the U.S by a non U.S. citizen the child automatically becomes an American citizen.
Yes. It is called the 14th Amendment. We were in the midst of the War between the States. The law basically naturalized all of the slave babies and conferred legal status and rights to slaves. This was very important as it turned a corner that the U.S. could not go back around and put a final nail in the coffin of slavery. Slavery was not allowed to legally exist as long as slaves were being brought here and having babies. It was also instrumental during the 1890's-1910's with mass migration to America. The industrial Revolution was creating unprecedented demand for workers, this Amendment helped pave the way for the population growth America needed, obviously not a problem we have now. There were no social programs for these migrants to abuse as we see today. There is a movement to revisit the 14th Amendment. It will likely be changed based on polls running at 80% against the Amendment.

Unfortunately that IS true. There have even been cases of pregnatn women here on vacation that have gone into labor early and given birth that didn't want their child to be an American citizen. Once the child is born, the process of removing that citizenship is daunting to say the least. AND in some foreign countries, a child that is an American citizen is not always considered to be a citizen of that country and both parents and child been known to have many legal problems because of that law if they wer unable to ge the citizenship removed before going home. Sometimes there is even trouble in being allowed to take their child home with them.





So yes it is true.
Unfortunately we have perverted the original intent of the 14th amendment to mean yes, but that was not always the case. No one really knows at what point in time we just started handing out US citizenship like some cheap prize out of a cereal box.





Many people like to quote the text

Even a cursory examination of the statement reveals that there are caveats. Otherwise it would simply read;





';All persons born or naturalized in the United States are citizens';





Senator Jacob Howard argued to add the words ';and subject to the jurisdiction thereof'; because he wanted to make it perfectly clear that the mere accident of birth in the United States was NOT SUFFICIENT to justify citizenship.





If you read the Congressional Globe on the 39th Congress that passed the 14th amendment, you will see that there was considerable debate on the floor of Congress as to whether Howards addendum was worded strongly enough.





In short, until the 14th is interpreted the way it's authors intended, The US passes out citizenship and welfare to anyone that can stumble across the border and drop anchor.
If they were born here and were given an American birth certifacate, then this means that they are also intitled to recieve a soical security card...so yes, the answer is true!
The government does not possess children; they are not chattel. Children belong to their parents and even if the chidl is a US citizen the government cannot stop you from taking your child and returning to the home country (which sounds like what your question actually is.)


Children born here are US citizens regardless of their birth parent's nationality.
I am going to assume you are not from this country, which would be understandable that you might not know that.





But yes, anybody born in the USA, is automatically a US Citizen.
